You saw the advertisement.
You called the dealer to make sure the car was available.
But when you went down to the dealership, they pulled a bait-and-switch. They told you the advertised vehicle wasn’t available anymore, the offer had expired, you didn’t qualify for the deal—or some other BS excuse.
When a dealership advertises a vehicle at one price and then tries to sell it to you at a different price, that’s false advertising. Plain and simple.
To prove your claim, make sure you get a copy of the advertisement before the dealer removes it from their website or wherever it was posted.
It’s especially helpful if the ad includes the vehicle identification number (VIN).
But what you may not realize is that the dealer didn’t just hurt you with the inflated price. You also ended up paying taxes on that higher price—taxes you wouldn’t have owed if they had honored the original, advertised price.
New York has a specific law that prohibits false advertising.
